What Are Your Rights If You Are Homeless in Brighton?

If you are homeless or at risk of homelessness in Brighton, it is important to know that you have legal rights. The law places duties on Brighton and Hove City Council to help you — and knowing your rights can make a real difference in getting the support you need. The Right to an Assessment

Under the Homelessness Reduction Act 2017, if you approach Brighton and Hove City Council and say you are homeless or at risk of homelessness, you have the right to a housing needs assessment. The council must assess your situation and cannot simply turn you away without providing help.

The Right to a Personalised Housing Plan

If you are found to be homeless or at risk of homelessness within 56 days, the council must produce a personalised housing plan — a written document setting out the steps the council and you will take to prevent or relieve your homelessness. You have the right to see this plan and to have it reviewed.

The Right to Emergency Accommodation

If you are in “priority need” — for example, if you have children, are pregnant, are fleeing domestic abuse, or have a significant vulnerability — you may be entitled to emergency accommodation while your case is assessed. This should be provided on the same day you approach the council if you have nowhere safe to sleep that night.

The Right to Appeal

If the council makes a decision about your homelessness case that you believe is wrong, you have the right to request a review of that decision. You should seek independent legal advice before doing so. Shelter and Citizens Advice offer free legal advice to homeless people.
